- Pro and Max — messaging with Use AI Instant is unlimited, subject to fair use, and runs at priority capacity. It never draws from your premium model allowance.
- Free — everyday chat with Use AI Instant within a limit. The limit is dynamic and not disclosed, and the service is provided as-is. Free doesn't include premium model usage.
- At your premium limit (Pro and Max) — Use AI Instant is right there in the model picker, so you keep working. Reaching your premium limit changes which model answers, not whether you can chat.
What "unlimited, subject to fair use" means on Pro and Max
For a person having conversations — even heavy, all-day use — unlimited means unlimited. Fair use exists to keep the service fast and reliable for everyone, and applies to patterns like bots and scripts, account sharing, and reselling access — the full details are in the Fair Usage Policy.
Fair use is not your premium allowance
These are two separate things:
- Your premium model allowance (Pro and Max) is the amount of premium model usage included in your plan. Reaching it switches your chats to Use AI Instant — allowances, resets, and switching back are covered in How usage limits work.
- Fair use applies to how the service is used, not how much you've used it.
Reaching your premium limit is normal — it isn't a fair-use issue.
